Using Viscacha

Terms of Use

These terms apply to the Viscacha macOS application, viscacha.app, and its optional launch waitlist. Viscacha is provided by Nikolai Vladimirovich Solovev, an independent developer based in Japan ("we", "us", or "the developer"). Contact legal@viscacha.app for legal questions.

Acceptance and eligibility

By installing or using Viscacha after being given access to these terms, you agree to them to the extent permitted by applicable law. If you do not agree, do not use the app. You must have the legal capacity to accept these terms or any permission required from a parent or guardian, and meet the requirements of the AI providers you use. If you use the app for an organization, you must have authority to do so.

Planned subscriptions and hosted access

Viscacha is a macOS app in development and has not yet launched. We plan to offer paid Viscacha Pro subscriptions with hosted Claude access and a usage cap. Requests will pass through our backend to Anthropic using credentials managed by Viscacha; users will not need their own API key for hosted access. Claude access will be limited to countries supported by Anthropic.

Hosted access and Pro are not currently available. App pricing, subscription pricing, usage limits, availability, and any purchase terms will be published before paid access is offered. Viscacha does not offer a free, unlimited hosted model service. Joining the waitlist does not create a subscription or authorize any payment.

Current development builds also support your own API credentials, existing Codex authentication, and local models. Those connections are separate from the planned hosted service. You choose what content to submit and what to do with the results.

Third-party AI providers, Codex account plans, proxy operators, and other services you choose may charge you separately. You are responsible for those charges and for checking their pricing and limits. Any token-cost estimate displayed by Viscacha is informational and may differ from a provider's bill; it is not a charge by Viscacha or a price guarantee.

Permission to use the app

Subject to these terms, we grant you a non-exclusive license to install and use Viscacha on Macs you own or control for your own personal use or an organization's internal use. You may make reasonable backup copies. This permission does not authorize selling or distributing the app, sublicensing it, or presenting it as your own product without our permission. It does not restrict acts that applicable law or a component's separate license permits.

Viscacha and its original design, code, and artwork remain the property of their respective rights holders. Open-source components are governed by their own licenses, which take precedence for those components; relevant notices are available in the app's Open Source Licenses screen. Other product names and trademarks belong to their owners. Integration with an AI provider does not imply endorsement or affiliation.

Your content and choices

You decide what text, questions, images, and other content to use, where to send it, and what to do with the results. You are responsible for having the rights, permissions, and lawful basis needed to process and transmit that content, including another person's personal information, an employer's confidential material, or copyrighted work.

We do not claim ownership of your input or AI output merely because you use Viscacha. Any rights in output depend on applicable law and the terms of the provider that generated it. You are responsible for reviewing output and deciding whether you may use, publish, or share it.

Use the app lawfully, follow the terms of your chosen providers, protect your credentials, and verify the content and destination of a request. Do not use the app to access accounts or systems without authorization, infringe others' rights, bypass provider restrictions, or interfere with the website or another system. These responsibilities do not exclude any responsibility the law places on the developer.

Independent providers and local models

When you configure a direct provider connection in a development build, Viscacha connects to that provider or endpoint, optionally through your chosen proxy. You establish and maintain any required accounts or credentials yourself. Those services have their own terms, privacy policies, prices, geographic restrictions, and usage limits. We do not control their availability, decisions, outputs, data retention, or billing, and cannot provide refunds for their charges.

For the planned hosted Claude service, Viscacha will manage the Anthropic API credentials. Viscacha Pro will be separate from Anthropic's Claude Pro subscription, which does not by itself include API usage.

The Codex integration depends on a compatible runtime installed on your Mac and its existing authentication. Apple Foundation Models and local servers depend on compatible hardware, operating-system features, and your configuration. Provider support, models, and capabilities may change or become unavailable.

AI results and professional decisions

AI results can be inaccurate, incomplete, biased, outdated, or unsuitable, even when they sound confident. Viscacha does not verify them or provide medical, legal, financial, or other professional advice. Independently check important information before acting on it, and obtain qualified advice where appropriate. You make decisions about how to use the app and its output.

Privacy and local data

The Privacy Policy describes local storage, permissions, provider connections, and the separate website waitlist. In current development builds, the app does not upload your prompts, AI responses, request history, or API keys to a Viscacha content-storage backend. Data you submit to an AI provider is handled by that provider. Planned hosted access will route request content and responses through our backend; we will publish the actual data handling and retention rules before it becomes available.

Keep any backups you need and manage your own local data and exports. History may be saved on your Mac, and an export can contain plain-text secrets if you choose to include sensitive data. Uninstalling the app does not necessarily delete local records, Keychain entries, backups, or separate provider data.

Website and launch waitlist

Joining the waitlist is optional and free. By submitting an address you own or are authorized to use, you request exactly one email when Viscacha launches. There is no confirmation email, newsletter, or beta mailing. A signup does not create an app account, require a purchase, or guarantee a release date or access. If the app is not released, there may be no launch email. You can withdraw your request by emailing legal@viscacha.app, preferably from that address.

The website previews an app in development. Features, appearance, compatibility, and supported providers can change. Do not submit other people's addresses without permission, automate abusive signups, or attempt to access the private waitlist. We may reject or remove abusive or invalid entries.

Availability and warranties

To the extent permitted by applicable law, Viscacha and the website are provided "as is" and "as available", without additional warranties of accuracy, suitability for a particular purpose, uninterrupted operation, or compatibility with every system or provider. We do not promise a service level, continued development, updates, or a particular support response time. Features, distribution, and website availability may change or be discontinued.

This provision does not exclude any warranty, remedy, or obligation that applicable law makes mandatory.

Liability

Where applicable law permits a limitation, and only for losses resulting from ordinary negligence, the developer's liability is limited to direct losses that were reasonably foreseeable. In those circumstances, the developer is not liable for indirect or consequential losses, including lost profits or business opportunities.

No limitation in these terms applies to intentional misconduct or gross negligence, or to liability that cannot lawfully be excluded or limited. Nothing in these terms excludes liability for death or personal injury where it cannot be excluded, removes mandatory consumer rights, or gives the developer sole discretion to decide whether liability exists. Whether access is free or paid does not by itself remove rights the law gives you.

Stopping use and changes to these terms

You may stop using Viscacha at any time. We may terminate the license for a material breach of these terms, subject to applicable law; if that happens, stop using the app. Provisions concerning ownership, content responsibility, liability, and applicable law continue to apply where relevant.

We may publish revised terms with an updated date. Material changes will be brought to your attention by a reasonable means and will apply only prospectively, with notice or agreement where required by law. Publication alone does not override any legal requirement for notice or consent, remove accrued rights, or authorize a charge for your existing free use.

Applicable law and contact

These terms are governed by the laws of Japan, subject to any mandatory protections that apply in your place of residence. They do not restrict any right to bring a claim before a court or authority available under applicable law. If a provision is unenforceable, the remaining provisions continue to apply to the extent legally possible.

For questions, complaints, or legal notices, contact Nikolai Vladimirovich Solovev at legal@viscacha.app. A postal address is available without undue delay on request.
